Party Wall etc. Act 1996

The Party Wall etc. Act 1996 is a legal framework that provides the owners of land and buildings with rights to carry out certain building work, as long as the correct legal procedures are followed. Exercising and maximising the rights given under the Act for the developer and protecting the neighbouring owners from the proposed work requires the specialist knowledge of party wall surveyors. Waldrams’ party wall services extend to licensing to provide a full neighbourly resolution service for developers or building owners looking to build. For the neighbour (or adjoining owner) consultation, advice and support are given to ensure their land and buildings gain maximum protection from the proposed development.

Building work that requires a notice under the Party Wall etc. Act 1996 includes:

  • Section 1: new building on or up to the line of junction
  • Section 2: repair etc. of an existing party wall
  • Section 6: adjacent excavation and construction within 3 or 6 metres, with deep foundations.

The sections covered within the Act can be seen as higher risk excavation work (Section 6), work to existing shared structures (Section 2) or work that requires agreement to build on or potentially access the adjoining land to undertake (Section 1). Adjoining owners in receipt of a valid notice have the right to appoint a surveyor to act on their behalf, to have a condition survey to document their land and buildings before the start of building work and to have an appointed surveyor to represent them and award damages if needed. The costs for party wall surveyors are covered by the building owner seeking to undertake the building work, who is also responsible for covering any repair costs caused by executing the notified building work.
